Carver Conservation Commission Denies Indian Street Lot 2, Cites Local Bog Setback Bylaw
CARVER — June 18, 2025 — Carver Conservation Commission denies one Indian Street residential lot and approves another under the town's 100-foot cranberry bog setback bylaw. At the June 18 meeting, the commission voted 3-0 to deny a Notice of Intent for Indian Street Lot 2 (NOIDEP SE126-698), finding the proposed house in conflict with the local bylaw's General Provisions Section 281-1 — which prohibits residential structures within 100 feet of a cranberry bog — as well as with state wetlands law; engineer Rob Carlison of Grady Consulting told commissioners the applicant had explored every configuration but faced a 16-foot foundation-depth differential that made relocation "probably the only way" to build. The commission separately voted 3-0 to approve a revised plan for adjacent Indian Street Lot 1 (NOIDEP SE126-7), after Carlison redesigned the house location to fall entirely outside the 100-foot setback, with conditions including a split-rail fence with wetland signage at the 65-foot line and a pervious driveway. "I don't know how you did that — you did something magical," one commissioner told the engineer. Commission Chair Savory was absent; three members constituted the acting quorum.
