Carver zoning board delays ADU ruling, orders site visit

Carver zoning board stalls ADU appeal over an unfinished basement's square footage. The Zoning Board of Appeals voted unanimously to schedule a site visit and ask town counsel for a ruling before deciding whether a 900-square-foot accessory dwelling unit at 66 Pond Street meets the bylaw's 50 percent size cap. Petitioner Paul Topham argued the town should count the home's unfinished, 960-square-foot basement toward gross floor area, citing state code and an Attorney General ruling against "finished basement" language elsewhere.

Board member Mark Poirier called it "the first time" the board weighed an unfinished basement in an ADU case. The board also approved its August 4 minutes, 4-0 with one abstention, and tabled a proposed increase to the town's 700-square-foot garage-size cap, with Poirier floating "14, between 1,000 and 1,400" square feet as a starting range. The board reconvenes on the ADU case September 30 after a September 26 site visit.
